Terms of Service

1. Purpose and acceptance
These Terms of Service (the "Terms") govern access to and use of www.pitchmusiccenter.net (the "Website") and of the services and products offered on it by Nosh Productions, sole proprietorship of François Pelissou ("we", "us", "Pitch Music Center").
By browsing the Website, creating an account, listing a profile or placing an order, you accept these Terms. If you do not accept them, please do not use the Website.
2. Our services
Pitch Music Center provides resources and guidance for artists, songwriters and music professionals, including:

a professional directory of music industry professions and contacts (the "Directory");

free articles, guides and resources;

paid digital products, such as the book Music Business Express, its companion video training (52 videos), webinars and coaching programs including Backstage Pro 30 (the "Products").
Some Products may be subject to specific conditions shown on their sales page. Those conditions prevail over these Terms where they differ.
3. Access and account
The Website is accessible free of charge, except for paid Products. Some features require an account. You agree to provide accurate information, keep your login details confidential and tell us promptly of any unauthorized use of your account. You are responsible for all activity carried out under your account.
The services are intended for users aged 16 or over. Users under 18 should use paid Products with the consent of a parent or guardian.
4. The Directory
The Directory is an information tool. Listing a professional does not mean that we endorse, certify or guarantee their services. Any relationship between a user and a listed professional is entered into directly between them, at their own risk.
If you submit a listing, you confirm that the information is accurate, that you are entitled to publish it, and that it does not infringe any third-party right. You understand that a listing is publicly visible. We may refuse, edit or remove any listing that is inaccurate, outdated, misleading or contrary to these Terms.
5. Orders, prices and payment
Prices are shown on each sales page, in the currency indicated. An order is final once payment is confirmed. Payments are processed by secure third-party payment providers; we never store your full card details.
We may change our prices at any time. The price applicable to an order is the price shown when it was placed.
6. Delivery of digital Products
Digital Products are delivered online, by access to a member area, a download link or an invitation to a live session, sent to the email address you provide. Access to video training is granted for the duration stated on the sales page, or for the lifetime of the Website if no duration is stated.
If a live webinar or coaching session must be rescheduled, we will offer you a new date or a recording.
7. Right of withdrawal and refunds
If you are a consumer, you may have a statutory right to cancel a distance purchase within 14 days. For digital content supplied immediately (videos, e-books, member areas), you ask us to start delivery before the end of that period and acknowledge that you lose your right of withdrawal once access begins, to the extent permitted by the law that applies to you.
For services such as coaching, you may cancel within 14 days of purchase. If the service has already started at your request, the amount due for the part already provided may be retained. Any additional satisfaction guarantee is stated on the relevant sales page.

8. Acceptable use
You agree not to:

use the Website for any unlawful, fraudulent or misleading purpose;

collect Directory data by automated means (scraping, bots) or use it to send unsolicited bulk messages;

share your access to paid Products with others, or resell, record or redistribute them;

attempt to disrupt the Website, its security or its servers;

publish content that is defamatory, offensive, discriminatory or infringes the rights of others.

9. Intellectual property and licence
All content on the Website and in the Products belongs to Nosh Productions or its licensors. Purchasing a Product grants you a personal, non-exclusive, non-transferable licence to use it for your own professional development. No other right is granted.
10. Content you submit
You keep ownership of the content you submit (listings, comments, testimonials). You grant us a free, worldwide, non-exclusive licence to host, display and reproduce it on the Website and our social media channels, for as long as it remains published, for the purpose of operating and promoting Pitch Music Center.
11. No guarantee of results
Our resources and Products share experience and methods from the music industry. They do not guarantee any particular outcome, such as a record deal, a placement, streaming figures or revenue. Your results depend on your own work, talent and circumstances. Nothing on the Website constitutes legal, tax or financial advice.
12. Limitation of liability
We make reasonable efforts to keep the Website available and accurate, but we do not guarantee uninterrupted or error-free access. To the extent permitted by law, our liability for any direct damage arising from a Product is limited to the price you paid for it. We are not liable for indirect losses, such as loss of earnings or opportunities. Nothing in these Terms limits liability that cannot be limited by law.
13. Suspension and termination
We may suspend or close an account that breaches these Terms, after notice where reasonable. You may close your account at any time by writing to us. Sections 9 to 12 and 15 remain in force after termination.
14. Changes to these Terms
We may update these Terms from time to time. The version in force is the one published on the Website on the date of your use or order. Significant changes will be announced on the Website or by email.
15. Governing law and disputes
These Terms are governed by the laws of the State of Israel. If you are a consumer residing in the European Union, you also keep the protection of the mandatory provisions of the law of your country of residence.
In case of a dispute, please contact us first at contact@pitchmusiccenter.com so we can seek an amicable solution. Failing that, the courts of Haifa, Israel, have jurisdiction, without prejudice to the right of consumers to bring proceedings before the courts of their place of residence.
